(Dana Point, CA) A Dana Point crash caused by Bradley Gene Funk, 59, resulted in the death of Luis Adrian Morales-Pacheco, 13 of San Juan Capistrano Tuesday morning, November 17.
According to the Orange County Sheriff’s Department, deputies responded around 8:20 a.m. to Dana Point Harbor Drive and Park Lantern. They received reports of a collision between a vehicle and a pedestrian. When deputies arrived, they found Morales-Pacheco, suffering from severe injuries. Paramedics arrived and transported him to a hospital, where doctors pronounced him dead.
Officials said Funk allegedly drove onto a curb and hit Morales-Pacheco as he walked to school with his brother, who did not sustain any injuries. Witnesses helped deputies identify the vehicle, and Funk was located a few miles from the crash scene.
Deputies arrested Funk on suspicion of hit-and-run, DUI, and second-degree murder, as he has a prior DUI conviction, authorities said.
Overview on the Dana Point Crash
In a case involving both intoxication and fleeing the scene, investigators will rely on several key statutes. The Driving Under the Influence Law prohibits operating a vehicle while impaired by alcohol or drugs. Because the suspect reportedly has a prior DUI conviction and a fatality occurred, prosecutors may pursue further penalties under California Penal Code 191.5, which covers vehicular manslaughter while intoxicated.
The Hit-and-Run Statute also applies. This law requires any driver involved in a crash that causes injury or death to stop, identify themselves, and render aid. Leaving a victim without assistance is treated as a felony offense in California.
Finally, the Basic Speed Law could be reviewed to determine whether speed was a factor when the vehicle left the roadway and mounted the curb. These statutes will help investigators and prosecutors establish the events that led to the fatal Dana Point crash.
