(Madera County, California) A 13-year-old boy, and three others died in Madera County two vehicle crash on September 2nd.

According to California Highway Patrol, the collision occurred in Road 9 and Avenue 21, when a GMC Sierra, with two others in the vehicle, was driving east on Avenue 21 when it failed to stop at a red light. This lead the vehicle to crash into a Honda CR-V traveling northbound causing the death of four out of five victims in the Honda vehicle.

CHP are unsure whether drugs or alcohol played a factor in this collision.

The identified victims of the Honda vehicle are Pedro Chavez, 13, Pedro Chavez Garcia, 43, Gerardo Ramirez Aguilar, 36, and Cayetano Beyza Mendoza, 52.

Analysis on Road 9 and Avenue 21

If drugs and alcohol played a part in this collision, investigators may review California Code, VEH 23152 (a). This specifically states that it is unlawful to be under the influence of any alcoholic beverages while driving a vehicle.

When caught driving under the influence, investigators may want to check the legal/illegal limit of BAC. 23152 (B) states that it is unlawful to drive with a BAC of 0.08% or more, by weight, of alcohol. If the driver was driving a commercial vehicle, investigators may want to review 23152(d). This states that it is unlawful for commercial vehicle drivers to have 0.04 % or more of BAC, by weight, of alcohol while driving. When it comes to driving under influence of drugs, 23152 (f) states that it is unlawful to drive under the influence of any drugs.

If the driver was using a device while driving that caused the fatal collision, investigators may review California Code, VEH 23123 (a). This section prohibits wireless telephone unless it is designed to be used hand-free.  These code laws can help determine the violations of the driver involved in the Madera County two vehicle crash.
