(Arcadia, California) On September 17th at around 12:53 a.m. a woman was killed and struck in the Eastbound Foothill (210) Freeway, west of Fifth Avenue.
According to a CHP spokesperson, a vehicle struck the woman and the driver then stopped and stayed on scene. All eastbound lanes of Foot Hill (210) Freeway were temporarily closed but re-opened at around 4:40 a.m.
As of right now, there has been no identification on the victim and the driver.
Analysis on the Eastbound Foot (210) Freeway Crash
Often times, pedestrians are not supposed to be walking on freeways and because that was the case in this fatal accident, investigators may want to review California Vehicle Code 21960, which allows the Department of Transportation and local authorities to restrict the use of freeways, expressways, or any portions from pedestrians.
Another code law that investigators may want to review is California Vehicle Code 21950, which prohibits pedestrians to leave a curb or a safe area to walk or run on the same path of a driving vehicle, close enough where danger can be involved. If that was the case in this accident, and the pedestrian died, there is a possibility that when the family files a wrongful death claim against the driver, they may not receive compensation due to the pedestrian getting close to the driver’s vehicle to the point where they couldn’t avoid the pedestrian.
In regards to researching whether the driver was at fault, investigators may review California Vehicle Code 21950 (C) which requires drivers to exercise all care to pedestrians and reduce their speed or take any actions necessary in regards to operating a vehicle that prevents any danger to the pedestrian.
