(Maricopa, CA) Frances Max Eriksen, 48, died after a vehicle struck her bicycle in Maricopa, the Kern County Coroner’s Office reported.

On November 3, at around 5:30 p.m., per the coroner’s report, Eriksen rode a bicycle in the 400 block of California Street. At some point, a vehicle struck her, causing serious injuries. By the time first responders arrived at the scene, Eriksen succumbed to her injuries.

Legal Guidance on the California Street Crash

Eriksen was riding a bicycle on a public street when she was struck. California’s roadway rules recognize bicyclists as road users with legal rights and require motorists to adjust their driving to surrounding conditions.

California Vehicle Code 21200 generally gives people riding bicycles on highways the same rights and responsibilities as vehicle drivers, subject to bicycle-specific rules. Eriksen’s use of a bicycle does not, by itself, establish that she was required to yield to the vehicle.

Motorists must also comply with California Vehicle Code 22350, which prohibits driving faster than is reasonable or prudent for traffic, visibility, weather and roadway conditions, or at a speed that endangers people or property. This requirement concerns safe operation around a bicyclist, rather than simply compliance with a posted speed limit.

These provisions establish a framework for reviewing the encounter, but the coroner’s identification does not establish either person’s movements before impact. A finding of responsibility requires evidence about how the vehicle and bicycle came into contact.

    What the Family Can Do

You can request the coroner’s case reference for Eriksen and ask which law enforcement agency handled the California Street crash. The coroner’s findings address her death, while the collision report addresses the roadway events; identifying both records can help you obtain answers from the appropriate office.

If you have any concerns about navigating the legal process surrounding this incident, call 888-888-9285 to speak with a lawyer.
