(Mesa, Arizona) A suspected impaired driver strikes multiple vehicles, killing one person in Mesa Arizona.

According to the Arizona Department of Public Safety, the crash occurred at 1 a.m. on Wednesday at the eastbound lanes of US 60. Two vehicles stopped on the right side of the freeway to fix a flat tire and just when they were about to leave, a vehicle struck both cars, killing a woman and injuring five others.

Investigators believe the driver that struck the two vehicles was impaired but sustained non-life threatening injuries according to DPS and is now held into custody.

The eastbound lanes and eastbound ramp near Higley Road were temporarily shut down but re-opened just before 7 a.m. Wednesday.

Legal Analysis on the US 60 Eastbound Lanes Accident

Because the driver is suspected  to be under the influence of drugs or alcohol investigators may review (ARS) 28-1381, which prohibits driving under the influence of liquor, drug, and any vapor releasing toxic substances of liquor and drugs. This law also prohibits driving under the influence of a blood alcohol concentration of 0.08% or more.

If the driver was speeding which may have been in the case given that five people were injured and one had died, investigators may review (ARS) 28-701 which prohibits some of the followings listed such as driving with an increase of speed than reasonable and driving 65 mph. This is an important factor because the victims going back into their vehicle may not have been aware that a car was approaching them with an increased speed.
