(Escondido, California) On Monday at approximately 7:45 p.m., a crash occurred when a 47-year-old man stepped into traffic toward an oncoming vehicle in the northbound lanes of Centre City Parkway.
Police stated that the driver stayed on scene and cooperated with investigators. Authorities did not find evidence speeding, alcohol or drugs as a factor in regards to the driver. After the crash, a bystander rendered aid to the man before he was transported to a local hospital where he was unfortunately pronounced dead.
While investigation was taking place, Centre City Parkway was temporarily shut down for four hours.
Legal Perspective of the Centre City Parkway Crash
Because the 47-year-old stepped into traffic, investigators may review California Vehicle Code 21950 to which it prohibits pedestrians walking or running from a curb or safety area to the path of a vehicle close enough to constitute immediate hazard. This relates to the man’s actions due stepping into traffic. It is unknown whether he did it on purpose but if he did, he would likely face charges of vehicle homicide described under California Penal Code 192. This law code prohibits states that if one does a lawful commission that can result in death in an unlawful manner is vehicular homicide. This can cause the driver to be liable in the death and at fault which can financially affect the driver if the family of the pedestrian files a wrongful death claim.
When it comes to the driver, investigators may specifically review California Vehicle Code 21950 (d) requiring drivers to exercise safety to pedestrians while in any marked or unmarked crosswalk and should slow down their speed.
