    Pedestrian Struck by Vehicle in Montecito Heights

    A Pedestrian was struck by a vehicle at the Arroyo Seco (110) Parkway near Pasadena Avenue. The injuries of the pedestrian is unknown.

    (Montecito Heights, California) On September 22nd at approximately 2:57 a.m., a pedestrian was struck by a vehicle in Montecito Heights at the Arroyo Seco (110) Parkway near Pasadena Avenue. 

    According to the California Highway Patrol spokesperson, the pedestrian was taken to a hospital following the accident and the driver of the vehicle remained at the scene. The pedestrian injuries and identification are unknown at the moment.

    A SigAlerts was issued for the No.2 and 3 lanes following the crash and was cancelled at 4:12 a.m.

     Legal Perspective on the Arroyo Seco (110) Parkway near Pasadena Crash

    Because there is little information about the accident, there are so many possibilities of why the driver struck the pedestrian, especially in a parkway. If the driver was distracted using his or her phone while operating their vehicle, investigators may review California Vehicle Code 23123 to which it prohibits driving while using a hand-held device. Under this law code, drivers can not use a wireless telephone unless it can be used hand-free. Using a hand-held device can distract drivers from looking at what’s ahead of them, causing a vehicle crash that can result in fatality or injuries.

    Another possibility that caused the accident, is if the driver was driving under the influence. If alcohol or drugs played a factor, investigators may review California Vehicle Code 23152, which prohibits any act of driving while under the influence of drugs and alcohol and if drivers are caught violating this rule, it can lead to a variety of fines and penalties depending on the severity of the violation. 

    Can Vision Impairment be the Cause?

    Lastly, if impairment in vision plays a factor, investigators may want to research the requirements the Department of Motor Vehicles must follow in issuing a license if the applicants do not meet the requirements in vision to drive a vehicle. Investigators may review California Vehicle Code 12805 as it prohibits the department to issue or renew a drivers license if the person with a better eye is 20/200 or worse. It’s important to note that such vision loss or having less vision than required while operating can put you and others at risk.  If the department did issue a drivers license to an individual that has a 20/200 or worse on their better eye, under California Vehicle Code 13100, the license may be canceled or in any other words, terminated and the individual may reapply for a license.
