(Oceanside, California) Police are now searching for the driver that tragically killed Naidy Cruz, 31, from Hemet. at around 9:45 P.M., Sunday, near Gajoma lake road and Route 76.
Oceanside Police Department say the incident occurred when Cruz was in the middle of the road when at least two possible vehicles struck her. The scene of the hit-and-run collision was located between Gajoma Lake Road and Melrose Drive on the eastbound lanes.
Oceanside Police Department also confirmed that the victim was not homeless and there is no additional information available about this case. At this time, the police department released a statement saying “we are seeking witnesses and at least two vehicles that ran her over.
Analysis on Route 76
Based on this case, investigators may want to view the Pedestrian’s Rights and Duties law, code 21954 (a). This code states that pedestrians must yield to vehicles in cross or un-marked crosswalks in an intersection upon roadway so near as to constitute an immediate hazard.
Although this section of the rule says that pedestrians have to yield to vehicles, drivers have to exercise care and safety to any pedestrian upon a roadway.
Another law investigators may take a look at is the Accidents and Accident Reports law, code 20001. This law states the following important violation that drivers should not risk violating. One of them being (a). This rule states that drivers who hurt or killed another person should come to a stop immediately.
Violating this law can result in imprisonment in state or prison from two to four years. Or the driver can be given at least 90 days in state prison or fine that is at least or under $10,000, not below $1,000. Under © of code 20001, it states that anyone violating a crime of section 191.5 or paragraph (1) of subdivision © in section 192 of penal code can result in 5 years of state prison. One of the following in this section in regards to violation, is driving a vehicle in an unlawful act that can result in a manner of death and gross negligence.
