Legal Analysis on the 85th Street E-Scooter Accident

When it comes to hit-and-run accidents, investigators often review accident related laws to determine what exactly the hit-and-run driver has violated and what kind of punishments they shall face.

In this case, since both drivers struck the victim resulting in their death, investigators will likely review California Vehicle Code 20001. This law prohibits drivers from fleeing the scene after causing an injury or death. Because the drivers fled the scene, they will likely face serious punishments of imprisonment in a state prison for 2 to 4 years or imprisoned in a county jail for 90 days to a year.

It is also possible that the drivers were speeding which caused the fatal death of the rider. If that was the case, investigators may review California Vehicle Code 22350. This law prohibits driving above the reasonable speed or prudent due to weather, visibility, traffic, surface and width of highway and shall not speed enough that endanger others.
