(Oceanside, CA) A pedestrian was killed late Sunday night, March 1, in a State Route 76 accident.

According to the Oceanside Police Department, the fatal collision was reported at approximately 11:50 p.m. near the intersection of state Route 76 and Benet Road. Investigators said a white Toyota Corolla traveling eastbound on SR-76 struck a pedestrian who was believed to be crossing the highway from south to north just east of the intersection.

The pedestrian was pronounced dead at the scene. Authorities did not release the victim’s name, age, or city of residence. That information remained pending notification of next of kin.

Police said the driver of the Toyota remained at the scene and cooperated fully with law enforcement. Officials stated that driving under the influence was not considered a factor in the crash. Detectives with the OPD Major Accident Investigation Team continued examining evidence and interviewing witnesses.

It was not immediately clear whether the pedestrian was within a marked crosswalk or how traffic conditions may have affected visibility at the time. The investigation remained ongoing.

Analysis on the State Route 76 Accident

When a fatal pedestrian collision occurs on a major highway, investigators review traffic safety laws to understand what factors may have contributed, without assigning fault prematurely. These reviews often focus on pedestrian crossing location, driver attentiveness, and roadway speed.

Because the pedestrian was reportedly crossing outside the immediate intersection area, authorities may examine the Pedestrian Responsibilities Outside Crosswalks Law. This law requires pedestrians crossing outside marked crosswalks to yield to vehicles that pose an immediate hazard. Investigators may review lighting, lane positioning, and sight distance.

Officials may also consider the Basic Speed Law. This statute requires motorists to travel at speeds reasonable for traffic, visibility, and roadway conditions. Nighttime conditions can reduce reaction time, particularly on highways with higher posted speeds.

Investigators could further review the Duty of Drivers Toward Pedestrians Law. This law requires drivers to exercise due care to avoid colliding with pedestrians, even when pedestrians are outside crosswalks. These combined statutes help guide OPD’s evaluation of the State Route 76 accident as evidence continues to be analyzed.

    Support for the Family

If you are related to the person who died or are supporting their loved ones, staying in contact with investigators can help you receive updates and request official police and coroner reports when they become available.

You may also consider speaking with a qualified legal professional to better understand your options after a fatal highway collision. Emotional support from family members, friends, or grief counseling services can be especially important during a sudden and painful loss.
