Legal Analysis on the Indiana School Road Crash
Since the pedestrian was outside a crosswalk, it is possible that the driver and pedestrian would be at fault. Investigators may review the right-of-way laws.
Since the two drivers did not remain at the scene, this indicates that they violated A.R.S 28-701. This law prohibits drivers involved in an accident involving death or injury to flee the scene. Because they violated this law, they committed a class 3 felony and can be imprisoned under A.R.S 13-702 with a maximum of 8.75 years.
Because the driver did not yield to the pedestrian, they may have violated A.R.S 28-792. This law states that a driver must yield the right-of-way to pedestrians even when they are on the opposite half of the road. This may have been the case, leaving the driver at fault for not stopping their vehicle on time.
Even though the driver can be at fault, pedestrians are also responsible for their own safety in different circumstances. A.R.S 28-792, discusses that pedestrians are not allowed to leave a curb or a safety area onto the direction of a vehicle, close enough where the driver cannot avoid the pedestrian.
This may give investigators to review A.R.S 28-701. This law does not allow drivers to drive above than reasonable. Oftentimes, speed can determine how bad an injury resulting in death can be. For example, one person who speeds way above the legal limit, can strike the pedestrian hard enough where they get ejected onto the road. This can indicate that they landed on the roadway with a hard impact.
