    Santa Monica (10) Freeway, Pedestrian Killed

    A pedestrian was pronounced dead on scene after a vehicle struck him on Santa Monica (10) freeway resulting in lanes closed.

    (Santa Monica, California) At around 3:45 P.M., on the Santa Monica (10) Freeway, an unidentified pedestrian got struck by a vehicle yesterday, August 3rd. 

    According to the California Highway Patrol, the pedestrian accident occurred west of Vermont Avenue. 

    California Patrol Highway confirmed that the Los Angeles Fire Department pronounced the pedestrian dead on scene.

    All lanes remained closed until one lane on the far left reopened.  A SigAlert was also issued.

     

    Analysis on the Santa Monica (10) Freeway

    Investigators may take a look at the California Code (21954) Pedestrian Rights and Duties law, to identify the faults of the collision. Although there are many laws for drivers to yield to pedestrians, pedestrians also have some responsibilities to avoid such harm. In code (21954) (a) states that pedestrians in an unmarked or marked crosswalk should yield to all vehicles upon the roadway. As stated in this law, this subdivision does not relieve the driver from exercising safety to any pedestrian within a roadway.

    It is also important to note that reckless driving could be a factor to the collision. If the driver had the intention to  hit a pedestrian on the Santa Monica freeway,  then they may have violated the Driving Offenses law (23103) (a). This law states one of its following violations: if the driver of a vehicle is traveling on a roadway but is putting people around he or she as well as property in danger, then the driver is guilty of reckless driving.
