(San Diego, California) On September 23rd at 10:10 p.m., an unidentified pedestrian was struck by a SUV vehicle outside a marked crosswalk in the 1800 Block of Broadway.
According to San Diego police, the 21-year-old was driving a white 1997 Ford Explorer going westbound on Broadway while the pedestrian was crossing the 1800 block outside a marked crosswalk. From then on, the pedestrian walked onto the path of the Ford Explorer and got struck by it.
The pedestrian was found unconscious and not responding, and was transported to the hospital where they were pronounced dead.
Investigators have confirmed that driving under the influence did not play a factor.
Legal Analysis on the 1800 Block of Broadway Accident
Based on the given information, the pedestrian’s action was likely the cause of their own death. Due to this possible case, investigators may review California Vehicle Code 21950(b) to which it prohibits pedestrians walking or running onto the path of a vehicle from a curb or a safety location enough to result in immediate hazard. Since the pedestrian did go towards the path of the vehicle, that may have caused the driver to strike the pedestrian. It’s also possible that the pedestrian was running toward the vehicle resulting the driver to not avoid the pedestrian
Even though the pedestrian may have broken another law that may have resulted in their death, it’s still possible that the driver can be responsible for the death of the pedestrian under California Vehicle Code 20001(2) to which it states the following punishments if one is involved in a vehicle accident resulting in death or permanent serious injury:
- Punished with imprisonment at a state prison for 2-4 years
- Punished in a county jail for 90 days-1 year.
- Fined $1,000-10,000
- Imprisoned and Fined.
