(San Diego, California) On Monday, before 11:40 p.m., a 22-year old from Ohio was struck by two vehicles after hitting a guard rail on state Route 163.
The California Highway Patrol news confirmed that a black Harley Davidson was going north on SR-163. The rider struck the center median guard rail leading the rider to get ejected out of their vehicle and onto the road. From then on the rider was struck by a Tesla model Y operated by a 25-year old male and a Toyota Camry vehicle operated by a 48-year old male driver.
The rider was then critically injured and had passed. Reasons why he entered the guard rail is under investigation.
Both drivers stayed on scene and cooperated with investigators. Both drivers were not under the influence of any alcohol or drugs.
The Medical Examiner’s toxicology report for the rider is currently pending and his identification has not been released.
Analysis On State Route 163
Investigators may review California Vehicle, code 21950 (a) if the driver violated this specific law. This law discusses yielding to pedestrians in a marked/unmarked cross-walk in an intersection. This relates to the collision because two vehicles did not stop when they saw the rider in front of their vehicle, especially if the collision happened in an unmarked crosswalk of an intersection.
Investigators may also review (b) of this section as it states that pedestrians have a responsibility in protecting themselves and not leave a curb or safety locations and walk or run in the direction that a vehicle is approaching that can cause imminent hazard.
The two drivers may have also violated (C). This law states one of the followings that when faced with approaching pedestrians, you should slow down within an unmarked/crosswalk and exercise care, and to take any action necessary relating to operating a vehicle to keep pedestrian safe.
