(San Diego, CA) A 35-year-old man was killed early Thursday morning, December 4, in a Pacific Highway crash after being struck by a car in San Diego’s Morena neighborhood.

According to the San Diego Police Department, the fatal collision occurred around 4 a.m. near 4850 Pacific Highway, just south of Friars Road. Upon investigation, authorities learned a pedestrian stood in the roadway. At that moment, a 2024 Honda Civic driven by a 30-year-old woman attempted to swerve right but struck the man and a parked Toyota Prius.

Paramedics transported the victim to a nearby hospital, where doctors pronounced him dead. His name has not yet been released pending notification of family. Police said no one in the Prius sustained injuries.

Authorities urge anyone with information about the crash to contact the SDPD Traffic Division..

Overview on the Pacific Highway Crash

When a pedestrian fatality occurs, investigators assess several key traffic laws to determine liability. The Pedestrian Roadway Law requires pedestrians crossing outside of a crosswalk to yield the right-of-way to vehicles but still mandates that drivers exercise caution to avoid collisions whenever possible.

The Basic Speed Law obligates motorists to drive at speeds that are safe for current conditions, including lighting and visibility. Even if a driver is within the posted speed limit, failure to slow down when a pedestrian is detected can still constitute a violation.

Lastly, the Duty to Exercise Due Care Law compels drivers to remain alert and take all reasonable steps to prevent injury to pedestrians. These statutes will help investigators determine how the Pacific Highway crash occurred and whether any violations contributed.

    Support for the Family

The family of the victim should remain in contact with the San Diego Police Department’s Traffic Division for updates. They can provide a copy of the official collision report once it is available. This document will provide details necessary for insurance claims and any potential legal proceedings.

Families of pedestrians killed in traffic accidents may also seek assistance through California’s Victim Compensation Board. They can help cover funeral expenses, grief counseling, and related costs.

Finally, consider reaching out to a wrongful-death attorney experienced in pedestrian collisions. Legal guidance can help the family understand their rights and ensure accountability for the loss.

As the community mourns, local organizations such as the San Diego Trauma Intervention Program and other grief support services can offer comfort and resources to those affected.

If you have any concerns about navigating the legal process surrounding this incident, call 866-883-4318 to speak with a lawyer.
