Legal Analysis on the San Pedro Street Crash
When a motorcycle crash occurs, investigators often look at different possibilities as to why the collision occurred in the first place. They can review DUI and speed laws to determine what kind of violations were made, and then review penal laws on what the driver shall be punished with.
Because the driver hit the motorcyclist, causing the rider to be ejected, the investigators may discover that the driver was initially speeding before the collision. If so, they will likely review California Vehicle Code 22350. This code specifically states that drivers shall not speed above reasonable. Doing so can lead the driver to face serious charges. For example, in California Vehicle Code 22348, if you drive more than 100 mph, you may face a fine of $500 in a first conviction. A second conviction would result in a fine of $750 and a third conviction would result in a fine of $1,000.
If investigators learn the driver drove under the influence, then they have violated California Vehicle Code 23152. This law prohibits driving under the influence of any alcoholic beverages. It also specifically prohibits driving with a 0.08% or more than the legal limit. If the driver did one or both of the two, they may face serious punishments. Investigators may also review California Penal Code 191.5 to which this law discusses punishments the driver may face, such as 4 to 10 years in a state prison.
