(Buena Park, California) Last week, on October 14th, a vehicle slammed into a building at Rostrata Avenue and 8th street causing one woman to get trapped under the vehicle.

The woman had to be extracted from under the vehicle by the Orange County Fire Authorities. As a result, the victim sustained critical injuries. The vehicle that struck the building was a silver Sedan causing the first floor of that apartment to be completely destroyed. The two occupants in that vehicle were not injured and were shortly detained and released.

Legal Analysis on the Rostrata Avenue Building Accident

When a vehicle crashes into a property, oftentimes, investigators would review accident laws to determine what specific laws the driver violated. From there, they would also discuss consequences that the driver shall face.

Because the woman was trapped under the vehicle, it’s likely that she may face permanent injury. In this case, investigators will likely review  California Vehicle Code 20001 (b) (2). This law discusses that anyone that causes a serious, permanent injury or death can face 2-4 years in a state prison. The driver may also have to pay a fine of $10,000.

It is possible that the driver was also driving under the influence. The driver may have been too impaired to differentiate a road and a property. Due to this case, investigators are likely to review California Vehicle Code 23152. This law specifically does not allow drivers to be under the influence of any alcoholic beverages, even driving with a 0.08% or more of BAC. If this was the case for the Sedan driver, then they have violated this law.
