Legal Analysis on the Thunder Bird Road Crash

In pedestrian accidents, investigators often review the right-of-way laws to determine who was at fault that led to serious injuries. From then on, they may discuss consequences the drivers or pedestrians shall face.

Because the pedestrians were hospitalized for critical injuries and the two drivers who remained at the scene did not sustain injuries and in most cases, the ones that cause a fatal collision, tend to sustain minor to no injuries. It’s possible that both drivers may have been at fault. If the drivers struck the pedestrian, investigators may review A.R.S 28-792. This law requires all drivers to yield to pedestrians at an unmarked or marked intersection.

When discussing serious consequences that the drivers shall face, under A.R.S 28-144 they may have their driving privileges restricted or suspended from 180 days or to a year if the incident caused an injury. Because this collision left one in critical injuries, if the drivers were proven to be at fault, the drivers would likely face this consequence.
