    Nicole Linton, 41, Convicted of Six Counts of Second Degree Murder

    Nicole Linton was convicted of second degree murder for the killing of six people and an unborn child. Her attorney says she had a seizure.

    (Los Angeles, California) On October 2nd, Nicole Linton, 41, is now convicted of six counts of Second Degree Murder for killing six people, including an unborn child. 

    The crash first occurred at the intersection of La Brea and Slauson avenues. It is very likely that Linton will be sentenced to life in prison when she is sentenced on December 1st. According to her attorney, Linton suffered a seizure leaving her no control in stopping her Mercedes-Benz from crashing. 

    Deputy District Attorney Antonella Nistorescu played a video of the crash and stated “was an entirely preventable act.” and the prosecutor stated that Linton was conscious that entire time. She also mentioned that Linton was diagnosed with bipolar disorder, but refused to take prescribed medication.

    Linton’s attorney argued stating that she was “in no way angry or rageful” and was perfectly normal before she had a seizure. They also stated that sometimes a medical emergency occurs while driving and that it is not murder. 

    Legal Analysis on the Second Degree Murder Case

    There are a few law codes that investigators may review in regard to Nicole Linton’s second degree murder. They may review first degree and second degree convictions as well as punishable crime laws in regard to her alleged seizures before striking the victims.

    Before convicting Linton with second degree murder, investigators may review  California Penal Code 189(a). This section states the following actions are considered as first degree like arson, burglary, train wrecking. Investigators likely made their final conclusion based on subsection(b). This specific section confirms that whatever action is not stated in 189 (a) is second degree murder. 

    The prosecutor may give investigators a reason to review California Penal Code 25(b) if the prosecutor proves Linton’s alleged seizure resulted in the killing of six people including an unborn child. This code requires prosecutors to provide strong proof that their defendant did not understand what was right or wrong leading up to their actions. In many cases that does not always work and the person has to face serious consequences. Based on Linton convicted with second degree murder, she may face 15 years to life as stated under California Penal Code 190.
