(San Juan Capistrano, California) Orange County Sheriff’s Department confirmed that an 86 year old man, Anthony Konstantine Kalomas, is suspected in killing 23-year old. The 23- year old was identified as Cesar Amilcar Zuniga Ruiz, of Los Angeles.
The tragedy occurred on Monday, at around 12:30 a.m. at the Ortega Highway and La Novia Avenue . The 86 year old man, Anthony Konstantine Kalomas, allegedly struck Cesar and drove off without stopping his vehicle.
The collision is under investigation following the arrest.
Could Impairment in vision be the reason for the collision?
It is widely known that when you get older you can seem to become stiff or less flexible in hearing, and seeing from far away. Which begs to question if the 86 year old driver had any vision problem before striking the 23 year old.
Investigators may want to review whether the 86 year old violated any law that prohibits him from operating a vehicle if they have any diagnosed eyesight issues or the department that issued him the drivers license . In California under code law, Issuance and Renewal of License 12805(1) the department are not allowed to issue a driver license or renew a driver license whose best visual acuity is at a 20/200 or worse in that person’s better eye which would be verified by the optometrist or ophthalmologist. No one is allowed to even use a bioptic telescopic or similar lens in order to meet the 20/200 visual acuity standards. This may be the cause of the pedestrian fatal death.
Could The Driver Be Speeding?
We don’t know if Anthony Konstantine Kalomas was speeding. Speed can play a factor in the measured impact of someone’s death. If a driver was speeding too hard, the person they hit can have life-threatening injuries or die right at the moment.
If the driver increased his speed than reasonable, he may have violated the Speed Laws code 22350. Under this law it states “No person shall drive a vehicle upon a highway at a speed greater than is reasonable or prudent having due regard for weather, visibility, the traffic on, and the surface and width of, the highway, and in no event at a speed which endangers the safety of persons or property.”
