(Santa Ana, CA) A Grand Avenue collision killed Andrew Rodriguez, 39, of Wilmington resulting in lane closures for several hours in Santa Ana.

On Wednesday, August 27, at 11:35 p.m., the Grand Avenue collision occurred. According to the Santa Ana Police Department, the incident happened at Grand Avenue near Grovemont Street.

When officers arrived at the Grand Avenue collision site, they found a crash between a vehicle and a bicycle, ridden by Andrew Rodriguez. After assessing Rodriguez, they pronounced him dead at the scene. The driver stayed and cooperated with officers in the investigation. Law enforcement confirmed that impairment did not play a role leading to the collision. Officials closed all lanes of Grand Avenue between Fairhaven and Santa Clara avenues.

Legal Opinion on the Grand Avenue Collision

A lawyer speaks to a client regarding an accident.

The Grand Avenue collision raises several California laws. Even without impairment, California law imposes strict duties on drivers when sharing the road with cyclists. California Vehicle Code 21200 gives bicyclists the same rights and responsibilities as drivers of motor vehicles. That means they are entitled to use the road lawfully and safely. Additionally, California Vehicle Code 21760, known as the “Three Feet for Safety Act,” requires drivers to provide at least three feet of clearance when passing a bicycle.

If Andrew Rodriguez crossed or rode near an intersection, California Vehicle Code 21950 may also apply. This law requires drivers to yield to pedestrians, including bicyclists lawfully crossing within intersections. Investigators will examine visibility, speed, and whether the driver failed to take reasonable precautions. Under California Vehicle Code 22350, the Basic Speed Law, motorists must drive only at speeds safe for current conditions.

    What the Family Can Do

The Andrew Rogriguez’s family has the right to pursue a wrongful death claim under California Code of Civil Procedure 377.60. This allows close relatives to seek compensation for funeral costs, loss of financial support, and the emotional toll of losing a loved one.

A wrongful death attorney can help by obtaining the full police report on the Grand Avenue collision. They can also interview witnesses and check for surveillance or traffic cameras in the area. Accident reconstruction experts may also be used to determine if speeding, distraction, or failure to maintain a safe distance from the cyclist played a role.

Even though the driver remained at the scene and cooperated, civil liability may still apply. By taking legal action quickly, the family can protect their rights and pursue the justice and accountability they deserve. While no legal remedy can undo the loss, holding the responsible party accountable can provide financial support and a sense of closure as the family grieves.

We at Accident News Now extend our deepest condolences to the family of the victim. We know this is a difficult time as you mourn the tragic and sudden loss of a loved one.
