(San Marcos, CA) An adult and a juvenile suffered injuries while riding an e-bike in a South Santa Fe Avenue accident in San Marcos.

On Monday, August 25, at about 6:26 p.m., the South Santa Fe Avenue accident occurred. According to the San Marcos Sheriff’s Station, it happened at the intersection of South Santa Fe Avenue and Bosstick Boulevard.

Upon arriving at the crash site, deputies found an e-bike, carrying an adult and a juvenile, injured. A vehicle struck them, prompting transportation to a hospital.  The vehicle’s driver and others involved remained at the South Santa Fe Avenue accident site. They all cooperated with the police investigation. Authorities ruled out alcohol and drugs as factors of the crash.

Legal Opinion on the South Santa Fe Avenue Accident

A lawyer speaks to a client regarding an accident.

The South Santa Fe Avenue accident highlights the growing safety concerns surrounding e-bikes on California roadways. Under California Vehicle Code 21200, people riding bicycles have the same rights and responsibilities as drivers of motor vehicles. At intersections, VEH 21802 and 21804 also come into play. These laws require drivers to yield the right of way when entering or crossing a roadway if another vehicle approaches. Additionally, California Vehicle Code 22350, the Basic Speed Law, requires drivers to travel at a safe speed for conditions. If the driver failed to slow down in time at the intersection, they may still be considered negligent.

What the Injured Riders Can Do

The adult and juvenile struck while riding the e-bike may bring personal injury claims against the driver if the investigation shows negligence. These claims can cover hospital bills, rehabilitation, pain and suffering, and any long-term care needs. Because one of the victims is a child, a settlement or judgment would require court approval to ensure the funds are protected for the child’s benefit.

An experienced attorney can help by obtaining the sheriff’s report on the South Santa Fe Avenue accident. They can also review any surveillance or traffic camera footage and interview witnesses. They may also work with accident reconstruction experts to determine whether the driver failed to yield or misjudged the e-bike’s presence. Even when alcohol and drugs are not involved, California law still holds drivers responsible when their lack of caution causes injury. By acting quickly, the victims and their families can secure financial support to aid in recovery.
