    South Coast Highway 101 Collision Injured Child in Encinitas

    (Encinitas, CA) A 64-year-old man was arrested on suspicion of driving under the influence following a South Coast Highway 101 collision in Encinitas on Wednesday evening that left a young boy injured, authorities said.

    Deputies from the North Coastal Sheriff’s Station responded around 5:59 p.m. on October 8 to reports of a two-vehicle crash and a pedestrian injury near the intersection of South Coast Highway 101 and West D Street, according to Sgt. Kristy Trampus.

    Investigators said a 2026 Chevrolet Silverado, driven by Edward De La Torre, traveled north on Highway 101. All of a sudden, it rear-ended a Toyota Prius near West D Street. After the impact, the Silverado veered off the road and struck the Gelato 101 Building at 480 S. Coast Highway 101.

    When the Silverado struck the building, it struck a young boy inside and briefly trapped him beneath the truck. Emergency crews freed him, finding him conscious and breathing when taken to Rady Children’s Hospital. Paramedics also transported De La Torre to a hospital with non-life-threatening injuries, while the Prius occupants were evaluated and appeared uninjured.

    The North Coastal Sheriff’s Station said the investigation remains ongoing and asked anyone with information to contact Sgt. Kristy Trampus at 760-966-3555.

    Overview on South Coast Highway 101 Collision

    Crashes involving suspected impaired driving often lead investigators to review several state laws. In this case, officers will examine the driver’s condition, vehicle speed, and road conditions to determine the exact cause.

    When alcohol or drug use is suspected, California Vehicle Code 23152 becomes central to the investigation. This law prohibits operating a vehicle while under the influence of alcohol or drugs. This holds drivers accountable for any harm caused as a result. Because authorities arrested the driver on suspicion of DUI, authorities will likely review test results and witness statements to confirm impairment.

    If excessive speed or loss of control played a role in the Silverado leaving the roadway, the Basic Speed Law may also apply. It requires drivers to travel at speeds that are reasonable and prudent for current conditions, especially near intersections or areas with pedestrian activity.

    Finally, because a pedestrian, particularly a child, sustained injuries, California Vehicle Code 21950 could be relevant. It requires drivers to use due care to avoid endangering pedestrians, even when they are not in a marked crosswalk. Investigators will use these laws and physical evidence to determine how the South Coast Highway 101 collision occurred.
