Legal Analysis on the Shoreline Drive Collision
Police are desperately determining whether speed played a factor. The search may have investigators review DUI laws and right-of-way laws to help determine what laws the driver violated.
In California, there are certain requirements in regard to speed. If the driver was speeding unreasonably, the driver has violated California Vehicle Code 22350. This law prohibits speeding enough to put others at risk or property. Speed could play a factor as it can determine how bad of an impact it has caused.
Because the driver struck the pedestrian, even though the teenager ran through different lanes, they may have violated California Vehicle Code 21950. Under this law, drivers are required to yield the right of way to pedestrians crossing an unmarked or marked crosswalk. Because the driver failed to do so they may face vehicular manslaughter under California Penal Code 191.5.Under this law, the driver could face imprisonment in the state prison for up to 10 years.
