(San Diego, California) On September 28th, a 66-year-old man killed a 70 year-old man at the 300 Block of El Cajon Boulevard at around 5:26 a.m..
According to investigators, the 66 year-old driver that struck the 70-year old man was driving a 2006 Mercedes E350 traveling eastbound in El Cajon Boulevard while the 70-year-old stepped into the street, the driver then struck him.
The department confirmed that the pedestrian was taken to the hospital where he was pronounced dead.

Because the pedestrian stepped foot into the street, investigators may review California Vehicle Code 21950 to which it prohibits pedestrians from leaving a curb, or safety area, run or walk onto the path of a vehicle, close enough where it can cause immediate hazard. Investigators may find this law code helpful, as it may relate to the 70-year-old’s actions. It’s possible that the pedestrian stepped foot onto the street when the 66-year-old was already too close to the pedestrian to yield the right-of-way.

Because the driver caused a fatal death, he may face serious punishments under California Vehicle Code 20001 such as imprisonment in a state prison for two to four years, or in a county jail for 90 days to a year, fined $1,000 to $10,000 or by both.
