(Oceanside, CA) An Oceanside Boulevard hit-and-run resulted in the death of Josiah Baker late Thursday night. Investigators believe impaired driving contributed to the crash.

On Thursday, September 25, at about 10:20 p.m., Oceanside police officers received calls about a man struck by a vehicle on Oceanside Boulevard just west of El Camino Real. Officers learned that a 2020 Ford Ranger heading east had hit Josiah Baker before continuing forward.

Investigators later identified the suspected driver as 65-year-old Oceanside resident Yolanda Orozco. Authorities said she admitted being behind the wheel and showed signs of intoxication when questioned.

Police confirmed that Baker suffered fatal injuries, though it remains unclear if he died at the scene or later at a hospital. Officers arrested Orozco on suspicion of a felony hit-and-run, with possible DUI charges still under review. The Oceanside Boulevard hit-and-run remains under investigation as detectives seek more witnesses.

Legal Perspective on the Oceanside Boulevard Hit-and-Run

A lawyer speaks to a client regarding an accident.

The tragic crash that killed Josiah Baker raises multiple serious issues under California law. When a driver strikes a pedestrian and fails to stop, criminal and civil consequences follow. To begin, Vehicle Code 20001 requires drivers involved in injury or fatal accidents to stop and provide aid. Leaving the scene, especially when a person is gravely hurt, can lead to felony charges and civil liability.

Authorities also noted signs of intoxication. Under Vehicle Code 23152, driving under the influence of alcohol or drugs is unlawful. If proven, this raises to a felony DUI, also raising a strong basis for civil negligence claims.

Because this case involves a pedestrian, Vehicle Code 21950 also applies. This section requires drivers to yield the right-of-way to pedestrians within crosswalks. Even outside a crosswalk, drivers must exercise care to prevent collisions. If the driver was impaired, the duty of care was almost certainly violated.

Guidance for the Family of Josiah Baker

For the family, this situation is devastating. They may bring a wrongful death claim against the driver, which could provide compensation for funeral costs, lost income, and emotional harm. If DUI is confirmed, the family’s case may be even stronger.

Insurance may also play a role. The driver’s personal policy, or potentially other sources, could help cover damages. Families should know that hit-and-run and DUI cases often involve complex claims, but legal action may still bring accountability and relief.

The most important step is to act quickly. Preserving police reports, witness statements, and toxicology results will be critical. An experienced attorney can help the family navigate these steps, ensuring they receive guidance during an incredibly painful time. This Oceanside Boulevard hit-and-run shows how one reckless decision can cause irreversible loss, leaving loved ones searching for answers and justice.
