Analysis on Warner Avenue and Yale Street
The Santa Ana Police Department Collision Investigation Units may want to look at the Pedestrians’ Rights and Duties law, code 21950. This code discusses the following requirements of both the pedestrians and drivers. They may want to identify if the driver was at fault. By doing so they may review 21950 (a). This specific requirement states that drivers have to yield-the-right of way to pedestrians even in an unmarked crosswalk or marked crosswalk in an intersection.
They may also want to see whether the pedestrian was at fault which can sometimes be the case in car collisions. Under (b) that states that any pedestrian should not suddenly leave a curb or any other place of safety. Walk or run in the path of a vehicle that is close where as to constitute an immediate hazard.
If speeding played a factor in the 35 year old fatal death, investigators may view Speeding Laws code 22350 which states, No person shall drive a vehicle upon a highway at a speed greater than is reasonable or prudent having due regard for weather, visibility, the traffic on, and the surface and width of, the highway, and in no event at a speed which endangers the safety of persons or property.
This law is very important in following to not result in any type of collision. Speed plays a big role in the impact of a car accident if involved. It can even cause imminent death.
So even if let’s say the pedestrian was at fault for suddenly leaving a curb, the driver may be at fault for striking the individual with a strong force, due to actually going above the speed than required.
