Legal Perspective on the Harvard Avenue Crash
When it comes to suspected DUI crashes, oftentimes investigators would have to review DUI laws to determine what section the driver had violated. Investigators are also likely to review penal codes to discuss punishments the drivers may face.
If the suspected drivers were proven to have driven under the influence, investigators may review California Vehicle Code 23152. This code specifically prohibits driving under the influence of any alcoholic beverages and drugs. In this case, if the two drivers were proven to be under the influence they have violated this law.
Because the driver’s DUI resulted in the death of the victim, investigators would also review California Penal Code 191.5 if the drivers were driving under the influence that resulted in death.
