Perspective on El Toro and Creekside
Because there is a suspected DUI driver in this collision, investigators may want to review the California Code, VEH 23152 to determine whether the motorcyclist should be charged with a DUI. (A) states that it is unlawful to be under the influence of any alcohol beverages while operating a vehicle. In this case, if Mathew did have alcohol in his system, he most likely violated this law.
Percentage of Alcohol in Blood
Investigators may want to review rules on alcohol in blood and the unlawful percentages that drivers can not be under the influence of. In that case, they may view (b) which states that it is unlawful to drive a vehicle with a 0.08 percent or above, by weight, of alcohol in his or her blood.
(F) Because of how broad this rule is, it seems as though the motorcyclist is very likely to be charged. The following rule is “It is unlawful for a person who is under the influence of any drugs to drive a vehicle.”
If the driver had both alcohol and drugs then investigators may review (g) of the code. This states that it is unlawful for someone to be under the influence of both alcohol and drugs.
