Kern County, CA (November 30, 2023) 27-year-old Leah Makiah Ida Phillips tragically lost her life on Wednesday, November 29th, when she was struck by a vehicle in Kern County. The fatal collision happened on California City Boulevard, not far from Deep Well Street, just before 6:30 p.m., authorities said.

Emergency personnel arrived at the scene and found Phillips lying on the shoulder of the eastbound side of the roadway. She was unresponsive and officers knew she needed immediate medical intervention. Officers from the California City Police Department gave Phillips life-saving measures and did everything they could, but in the end, with heavy hearts, they pronounced Phillips dead at the scene.

Upon further investigation into this fatal accident, officers discovered that Phillips had been driving a vehicle and pulled over onto the shoulder of the roadway. For reasons still unknown, she got out of the vehicle and ran into traffic, according to witnesses at the scene. Phillips was struck by a 2019 Toyota Avalon, driven by a 79-year-old man from Mojave, police officers said.

The man driving the Toyota stopped and cooperated with authorities following the collision. Officers with the California City Police Department do not believe drugs and alcohol were a factor in this deadly collision. They do not suspect speed to be a factor, either. Investigators are still working on this accident to try and figure out exactly what happened on California City Boulevard in Kern County.

Who Is Liable In A Kern County Pedestrian Accident?

Thousands of pedestrians are killed or seriously injured every year in pedestrian accidents. Who is responsible for these pedestrian accidents? According to the Centers for Disease Control, “An estimated 137,000 pedestrians were treated in the emergency departments for nonfatal crash-related injuries in 2017. Per trip, pedestrians are 1.5 times more likely than passenger vehicle occupants to be killed in a car crash.” There are a number of factors that could lead to a pedestrian collision including:

    –Speeding

    –Drunk driving

    –Driver distraction

    –Inclement weather

All drivers have a legal obligation to exercise due care in order to avoid hitting pedestrians. The family of any victim that died in a pedestrian collision may have legal recourse through a wrongful death claim. Damages in a civil claim can help cover lost wages, medical bills and suffering. A wrongful death attorney can examine all of the facts of your case and let you know what your legal options are.
