Legal Analysis on the Northbound I-15 Crash
When a fatal crash occurs, speed and impairment in alcohol and drugs can play a factor at the same time. In this case, investigators may want to determine if impairment in alcohol was a factor and speed by reviewing DUI and Basic Speed laws.
The driver who stopped at the center divider may be the father of the daughter who was called to the scene. Speed may have played a factor in the death of the father. The driver(s) may have also been under the influence of alcohol and drugs. The investigators may then review the impairment in alcohol and drugs law and penal codes to discuss punishments.
When two vehicles collide, impairment may have played a factor. Investigators may first review California Vehicle Code 22350. This law prohibits others from driving above the reasonable speed limit. An example specified in this law is speeding rather more than traffic around you or when through dangerous weathers.
If the driver(s) were impaired with alcohol or drugs, investigators may review California Vehicle Code 23152. This law prohibits drivers from operating a vehicle under the influence of any alcoholic beverages or drugs. Specifically, if the driver(s) was under the influence of alcohol, they may have had 0.08% or more of blood alcohol concentration in their system.
Since there was one person pronounced dead, if alcohol played a factor then the driver (s) violated the California Penal Code 191.5. Based on this law, the driver (s) can face up to four to 10 years in the state prison.
