(Long Beach, California) An investigation is still taking place on the death of Juvenale Banderas who was possibly killed by a hit-and-run vehicle.
Police are now asking the public to help identify the driver involved in the potential hit-and-run accident. They are searching for the driver of a black sedan with tinted windows and chrome trim.
The collision occurred this month on September 13th at around 7:25 p.m. when a pedestrian was walking outside of a marked crosswalk, north on Pacific Avenue when they struck the male pedestrian. In total, the pedestrian was hit by three vehicles and only one vehicle driver stayed on scene.
While a hit-and-run is possibly the cause of Bandera’s death, it is unclear whether investigators still believe that’s the cause of his death.
Legal Analysis on the Possible Hit-and-Run Crash
There are many factors that the driver may have caused in the death of Banderas, like speeding, driving while under the influence or even purposely striking the pedestrian. In regard to those possibilities, investigators may review California Vehicle Code 22350 to which it prohibits drivers speeding above the reasonable limit. Because the pedestrian had suffered traumatic brain injuries, it is likely that the driver struck him at a high speed leading him to his fatal injuries. If the driver drove more than 100 mph on his first infraction, he would be charged $500 dollars and may have his or her drivers license suspended by the court.
Because the driver caused a fatal death, he may face serious charges of imprisonment in a state prison for two to four years, in a county jail for 90 days to 1 year or get fined $1,000 to 10,000 or by both under California Vehicle Code Law 20001. Under this law code, it specifies that if one is involved in an accident that results in someone’s death under California Penal Code 192 (c) (1) or 191.5 and then flees the scene, would be imprisoned for 5 years.
