    Female E-Scooter Rider Dies By A Commercial Vehicle in Downtown San Francisco

    Woman dies in Downtown San Francisco when a commercial vehicle strikes her while riding her e-scooter on Market Street.

    (San Francisco, California) On August 7th at around 8:18 a.m. on Market Street near Powell Street, a commercial vehicle truck strikes a woman riding her e-scooter. 

    The San Francisco Police Department stated that the officers found the woman on scene with life-threatening injuries. They performed life-saving aid before medics arrived on scene. Unfortunately she was pronounced deceased on scene. 

    The commercial vehicle cooperated with investigators, confirmed by police spokesman, Officer Robert Rueca. 

    Delivery, commercial vehicles who are licensed can drive a portion of Market Street. As well as taxis, emergency vehicles, Waymo autonomous vehicles, and some high-end commercial vehicles from Uber or Lyft. When it comes to the bicycle lane of the street, e-bikes and scooters along with designated bike lanes. 

    Private and ride-share vehicles are not allowed to be driven in Market Street. 

    Investigators are looking on whether the commercial vehicle had a license in driving in Market Street

    Officer Rueca stated that the investigation was ongoing as well as finding surveillance cameras in regards to the collision.

    Analysis on Market Street

    Investigators may have reviewed the Weight law, code 35701 (a) if the commercial vehicle was not licensed to drive on Market street. One of the violation laws discussed in this code is that in any city, county for a residence district can prohibit the use of any commercial vehicles from using a street or any vehicle exceeding the maximum gross limit. This violation law does not correlate to any vehicle under section 1031 to 1036. 

    Investigators may have also reviewed Of Crimes Against The Person law, code 193 in regards to punishments in manslaughter. If the driver purposely killed the victim, (a)of the law discusses that it can lead to imprisonment in state prison for 3, 6 or 11 years. 

    If the commercial vehicle driver involuntarily killed the e-scooter rider, investigators review (b)  may determine that he will be faced with imprisonment pursuant to subdivision (h) of Section 1170  for 2, 3 or up to 4 years.
