Berkeley, CA (November 8, 2023) A person received fatal injuries after they were run over by a Bay Area Rapid Transit (BART) train in Berkeley on Tuesday night, November 7th. The accident happened at the North Berkeley Station, according to authorities. The person was said to have actually gone under the train, according to the transit agency.

BART police officers were contacted shortly after 11:00 p.m. and told by the transit’s agency operations center that a person was underneath the train at the station. BART officers as well as the Berkeley Police Department, arrived at the train station around 11:20 p.m. and closed the station so they could investigate the accident. They were also waiting on the coroner to arrive and take the body.

At approximately 11:25 p.m., the person was pronounced dead at the scene. The Alameda County coroner was called and arrived at the scene around 12:30 a.m. to take possession of the body, according to the Bay Area Rapid Transit.

The station wasn’t reopened until after 1:30 a.m., but following an investigation, officers found no sign of foul play. They reviewed the train station’s security footage as well, according to BART.

The coroner has not released the deceased identity and is waiting to contact the person’s next of kin. Authorities are still investigating to try and determine why the person went under the train in the first place.

    Liability In Berkeley Pedestrian Accidents

Thousands of pedestrians are killed or seriously injured every year in pedestrian accidents. According to the Centers for Disease Control, “An estimated 137,000 pedestrians were treated in emergency departments for nonfatal crash-related injuries in 2017. Per trip, pedestrians are 1.5 times more likely than passenger vehicle occupants to be killed in a car crash.” There are a number of factors that could lead to a pedestrian collision including:

             -Speeding

             -Drunk driving

             -Driver distraction

            -Inclement weather

All drivers have a legal obligation to exercise due care in order to avoid hitting pedestrians. The family of any victim that died in a pedestrian collision may have legal recourse through a wrongful death claim. Damages in a civil claim can help cover lost wages, medical bills and pain and suffering. A wrongful death attorney can examine all of the factors of your case and let you know what your legal options are.
