(Long Beach, California) On September 13th, at approximately 7:25 p.m., Juvenal Banderas was struck by three vehicles and only one stopped at the scene at Pacific Avenue.
When responding officers arrived at the scene, they found Banderas on the roadway and rendered aid until paramedics from the Long Beach Fire Department arrived at the scene and transported him to a hospital where he was later pronounced dead.
According to preliminary investigation, the pedestrian was traveling eastbound across Pacific Avenue outside of a marked crosswalk. The pedestrian entered the road from the center median when a white sedan struck him, a dark sedan, then a Jaguar 2021 vehicle struck him. The Jaguar driver stayed on scene and cooperated with investigators while the two other vehicles fled the scene.
Police stated that speed, distracted driving, and impaired driving does not appear to be involved in the fatal collision.
Legal Analysis on the Pacific Avenue Accident
Because this is potentially a hit-and-run case, investigators may review California Vehicle Code 20001, which requires drivers involved in a vehicle crash resulting in injuries or death, must stop their vehicle and stay on scene. Because the two drivers violated this code, the drivers may now face imprisonment at a county jail for at least a year, fined $1,000 to $10,000, or face both penalties.
Three drivers caused a fatal death, they may be imprisoned for 2-4 years in state or at a county jail for at least 90 days to a year is still possible for the judge to decrease or eliminate jail or prison time.
If the hit-and-run was actually due to driving under the influence, investigators may review California Vehicle Code 23152 which prohibits driving under the influence of any drugs, alcoholic beverages or under the influence of both.
