(San Diego, CA) A Sunny Summit Drive collision killed Francisco Rodriguez Nunez, 23, Wednesday afternoon in the Black Mountain Ranch area in San Diego.

On Wednesday, September 3, at an unspecified time, emergency crews received reports of the Sunny Summit Drive collision. According to the San Diego County Medical Examiner’s Office, it happened in the 16000 block of Sunny Summit Drive within a construction zone.

Upon investigating, authorities learned Francisco Rodriguez Nunez stepped off a concrete truck when a trailer struck him. The trailer was being towed through the active construction site when the collision occurred. Paramedics quickly arrived and transported Nunez to Palomar Medical Center in Escondido. Despite treatment, doctors pronounced him dead later in the day.

Officials confirmed Francisco Rodriguez Nunez died in the Sunny Summit Drive collision. The incident remains under investigation to determine workplace safety conditions and potential violations.

Legal Opinion on the Sunny Summit Drive Collision

A lawyer speaks to a client regarding an accident.

The Sunny Summit Drive collision that killed Francisco Rodriguez Nunez involves both traffic and workplace safety laws. Since this occurred in an active construction zone, investigators will carefully review liability. California Vehicle Code 21709 prohibits drivers from entering construction zones unless authorized. If the trailer entered an unsafe part of the site or moved without clearance, this law may apply. Another relevant law is California Vehicle Code 22350, the Basic Speed Law. It requires drivers to travel at safe speeds for conditions. In a construction area, even slow movement can be unsafe if visibility is poor or workers are nearby.

Because this case occurred at a worksite, California Labor Code 6300 also applies. These laws create strict requirements for workplace safety. Employers must provide proper safeguards to protect employees from hazards like moving vehicles and trailers. If investigators find inadequate safety barriers, training, or supervision, liability may extend to the construction company. Since the crash caused a fatality, California Vehicle Code 20001 applies. It requires drivers involved in injury or fatal crashes to remain at the scene and provide aid. Reports suggest that emergency crews responded, but investigators will still confirm compliance.

    What the Family Can Do

The family of Francisco Rodriguez Nunez may pursue a wrongful death claim under California Code of Civil Procedure 377.60. This allows them to seek compensation for funeral expenses, lost financial support, and the emotional toll of losing a loved one. In addition, they may have a workers’ compensation death benefit claim. Under California law, dependents of a worker killed on the job may receive financial benefits, including coverage for burial costs and ongoing support.

An attorney can help the family by reviewing the official accident report of the Sunny Summit Drive collision. They can also examin workplace safety records and interview witnesses. An attorney may also investigate whether the employer or subcontractors failed to meet safety standards. Though legal action cannot replace their devastating loss, it can provide accountability and much-needed financial support. It can also push for improved safety measures, helping prevent future tragedies in construction zones.

We at Accident News Now extend our deepest condolences to the family of the victim. We know this is a difficult time as you mourn the tragic and sudden loss of a loved one.
