Legal Analysis on the 69th Street Hit-and-Run Accident
When a collision involves a pedestrian crossing a marked or unmarked crosswalk, investigators often review the right of way law codes, and consequences that the driver may face.
Investigators would review the California Vehicle Code 21950 given the fact that this law requires drivers to yield the right-of-way to pedestrians when approaching an unmarked or marked crosswalk. The driver violated this code law by not giving the right-of-way to the pedestrian approaching outside of a cross walk.
Because the driver didn’t yield to the pedestrian, they would face serious charges under California Penal Code 193.5 for driving in an unlawful manner. This will result in the driver facing two to six years in state prison.
