Legal Perspective of the San Bernardino (10) Freeway Crash

When multiple collisions occur on a freeway, oftentimes it may be due to someone driving impaired, distracted or even recklessly driving. Because the crash led to a death, investigators would likely review reckless driving, impairment, and distracted driving laws to help determine what punishments shall be made following the crash.

If one or multiple drivers were distracted on their phones, they have violated the California Vehicle Code 23123.5. This law discusses that drivers can not use a hand-held wireless telephone or an electronic wireless communication device. The exception is if it is designed as a voice-operated or hand-free device.

Oftentimes when a person dies from a vehicle crash, it can be due to the high speed of a driver. This can cause the injured individual to sustain serious injuries that can be fatal. In this case, investigators may review the California Vehicle Code 22350.

From there investigators would determine what kind of speed laws the driver(s) violated. In this case, it may be California Penal Code 192. This law states that one who does an unlawful or lawful act that may produce death would be considered as vehicular homicide. If one of the vehicles drove above the speed limit with over 100 mph, it’s possible for the driver (s) to be charged for vehicular manslaughter with gross negligence.
