(Greenwood Village, Colorado) Greenwood Village Police Department charged Luis Enrique-Pena, 19, from Westminster, Colorado with Vehicular Homicide because of reckless driving, hit-and-run that involved death or injury and driving under a revoked license.
On August 30th, Greenwood Village Police responded to a report of a two vehicle crash. The crash occurred on northbound l-25, north of East Orchard Road at around 2:26 a.m. Officers arrived to the scene, they found a male unresponsive. The individual was pronounced dead at the scene.
Another driver fled the scene before officers arrived. The northbound lanes of l-25 was shut down for several hours while investigations were taking place. The lanes reopened at approximately 8:00 a.m.
Pena is held at the Arapahoe County Detention Center.

Criminally negligent homicide (1) (a) and 18-3-105 (b). 18-3-105 (1) (a) states that a person causing death with criminal negligence has committed criminal negligence homicide. (B) states that if a person drives a vehicle that proximately caused death to another individual commits criminal negligence homicide.
Investigators may review 42-2-125 Mandatory revocation of license and permit, if the driver had previous charges that resulted him to have a revoked license. 42-2-125 (1) of this code states that the department can revoke ones driver license if convicted with vehicular homicide or criminally negligent homicide. The driver had already had revoked license, Therefore he may have already committed vehicular homicide in the past.
If its confirmed that Pena was indeed charged with vehicular homicide in the past, investigators may review 42-2-202 Habitual Offenders- Frequency and Type of Violations. 42-2-202 (2) (a) of this code states that a habitable offender is a person having three or more convictions of any of the following separate and district within separate acts committed within seven years.
