Legal Analysis on the Blue Diamond Road Crash
When a wrong-way driver collision occurs, investigators will often look at right-of-way and impairment laws. They will then look at potential consequences the driver may face.
Because the driver drove the wrong way, it’s possible they failed to drive on the right-hand side on a two-divided highway. Under N.R.S 484B.227, it specifically states that every vehicle upon a two divided highway must drive on the right-hand side and shall not pass, cross or in any divided space, barrier, section or on a left turn. If the driver did not obey this law, then they may have faced oncoming cars in the opposite direction on their left, resulting in a head on collision.
If the driver was proven to be under the influence of intoxicated liquor then they may have violated 484C.400. Based on this law, they may receive their first offense within 7 years. This would also indicate that they are guilty of a misdemeanor. They may face imprisonment of 20 days to 6 months in jail.
