Legal Opinion on the East Main Street Collision

The East Main Street collision highlights the vulnerabilities cyclists face when sharing the road with cars. Under California Vehicle Code 21200, bicyclists have the same rights and responsibilities as drivers of motor vehicles. This means drivers must treat cyclists as lawful road users and exercise caution around them. At intersections, VEH 21802 and 21804 require drivers to yield the right of way when another vehicle is approaching closely enough to pose a hazard.

If speed was a factor, VEH 22350, the Basic Speed Law, requires drivers to travel only at speeds safe for conditions. Even within the posted limit, failing to slow for a cyclist ahead can be considered negligent. Investigators will also likely consider whether the bicyclist rode on a crosswalk, bike lane, or making a turn, which could affect how fault is assigned.

What the Injured Bicyclist Can Do

The injured rider has the right to pursue a personal injury claim if the driver is found negligent. This type of claim can help recover medical expenses, lost wages, and rehabilitation costs. An attorney can assist by obtaining the official police report on the East Main Street collision. They can also review witness statements and check for surveillance or traffic camera footage near the crash site.  If the driver lacks sufficient insurance, the bicyclist’s own uninsured/underinsured motorist coverage may also apply.  While authorities investigate the East Main Street collision, it’s important for the rider and their family to seek legal advice quickly.
