(Scottsdale, AZ) A long-time business owner died after an LA Milk Depot accident earlier this month when he was struck by a car in the store’s drive-thru.

Dennis Thornton, owner of the south Scottsdale convenience store near 87th Street and McDowell Road, closed his store on Dec. 7. Shortly after, a car struck him, prompting paramedics to transport him to a hospital. Despite life-saving measures, he died days later. Police say the investigation is now closed and the driver will not face criminal charges, describing the incident as a tragic accident.

On Friday evening, customers arrived to find the store dark and its parking lot empty. Many stopped to pay their respects, remembering Thornton as a neighborhood fixture for more than 40 years.

Overview on the LA Milk Depot Accident

When a pedestrian is struck in a private drive-thru lane, investigators often examine the Failure to Exercise Due Care Law. This statute requires drivers to take reasonable steps to avoid colliding with pedestrians. In the LA Milk Depot accident, officers evaluated visibility, vehicle movement, and pedestrian positioning before determining no criminal charges were warranted.

Because the incident happened in a low-speed area where vehicles and walkers regularly mix, analysts may also consider the Reasonable and Prudent Speed Law. Even modest speeds can be dangerous in confined, crowded spaces. Reviewing this law helps clarify whether the driver was traveling at an appropriate pace for the drive-thru layout and lighting conditions.

Investigators may additionally reference the Crossing and Pedestrian Safety Law, commonly applied when a person walks through areas not governed by standard roadway crosswalks. Its principles help explain how shared-use spaces, like drive-thru lanes, require extra caution from both pedestrians and drivers in the moments leading to the LA Milk Depot accident.

    Support for Thornton’s Family

If you were close to Dennis Thornton, you may wish to request the Scottsdale Police Department’s incident report. It can provide clarity about the findings and help with any insurance or estate-related steps.

Consider meeting with an attorney who can explain civil options. They can help you understand rights related to medical costs, funeral expenses, and loss of financial or emotional support.

Lean on community members who knew and cared for Denny. His store was a neighborhood gathering place, and many people are grieving alongside you. Support from others can help you navigate the difficult days ahead.

If you have any concerns about navigating the legal process surrounding this incident, call 866-883-4318 to speak with a lawyer.
