(San Marcos, CA) A 34-year-old pedestrian was killed late Saturday night, December 14, in a San Marcos Boulevard accident involving a pickup truck whose driver was later arrested on suspicion of DUI.

Deputies responded around 11:45 p.m. to the 900 block of West San Marcos Boulevard. When authorities arrived, they found the pedestrian lying in the westbound lanes. Despite lifesaving efforts by deputies and paramedics, first responders pronounced the victim dead at 11:58 p.m. Authorities have identified the victim as Benjamin Lo Cicero of San Marcos.

The driver of the maroon Ford F-150 stayed at the scene and cooperated with investigators. Deputies determined he was under the influence of alcohol. They arrested him on suspicion of driving under the influence. The investigation remains ongoing, and anyone with information is urged to contact the San Marcos station.

Overview on the San Marcos Boulevard Accident

When a pedestrian is struck in an active roadway, investigators often reference the Pedestrian Right-of-Way Law. This statute requires motorists to yield and exercise due care when a pedestrian is present, even if the pedestrian is not within a marked crosswalk. Reviewing this law helps determine how driver awareness and roadway conditions contributed to the collision.

Because deputies arrested the driver on suspicion of impairment, analysts apply the DUI Prohibition Law. Alcohol use can significantly impair judgment, reaction time, and vehicle control. This statute becomes central to understanding whether impaired driving directly affected the events leading to the San Marcos Boulevard accident.

Investigators may also evaluate the Basic Speed Law, which requires drivers to operate at speeds safe for nighttime conditions and pedestrian activity. Even moderate speeding after dark can reduce visibility and the ability to stop quickly. Reviewing this law helps clarify whether speed compounded the risk.

    Support for Cicero’s Family

If your loved one was Benjamin Lo Cicero, you should request the full sheriff’s collision report once it is available. It will provide essential details that can guide insurance or legal steps.

You may also want to speak with a wrongful death attorney who can explain options for funeral expenses, loss of support, and other compensation.

Lean on family, friends, and community support services in San Marcos during this difficult time. Sudden loss is overwhelming, and compassionate assistance can help you navigate the days ahead.

If you have any concerns about navigating the legal process surrounding this incident, call 866-883-4318 to speak with a lawyer.
