(Oceanside, CA) A pedestrian was struck and killed Monday evening, November 10, in a Mission Avenue collision near Mission San Luis Rey.

According to the Oceanside Police Department, the crash occurred around 6:45 p.m. on Mission Avenue near Francesca Drive. Investigators said an eastbound Chevrolet Tahoe struck the victim. Responding officers and paramedics arrived within minutes, but the pronounced the pedestrian dead shortly after.

Police said the driver of the Tahoe remained at the scene and cooperated with investigators. Intoxication does not appear to have been a factor in the fatal crash, according to the department. The identity of the victim has not yet been released, pending notification of next of kin.

Anyone with information about the incident is urged to contact Oceanside police spokesperson Gina Avalos at 760-435-4815.

Overview on the Mission Avenue Collision

When a pedestrian is struck while crossing or walking near traffic, investigators typically consider the Pedestrian Right-of-Way Law. This law requires drivers to yield to pedestrians within marked or unmarked crosswalks. It also enforces drivers to exercise caution when approaching them, even outside intersections.

If the pedestrian was crossing mid-block or outside a crosswalk, the Pedestrian Crossing Law may apply. It directs pedestrians to yield to vehicles but also emphasizes that drivers must still exercise due care to avoid a collision.

Because this fatal crash occurred after sunset, the Basic Speed Law may also be reviewed to determine whether the driver was traveling at a speed that was safe for nighttime visibility and roadway conditions. Each of these statutes will help Oceanside investigators determine how the Mission Avenue collision occurred and whether additional factors played a role.

    Support for the Family

You should remain in contact with the Oceanside Police Department for updates on the investigation and to request the official collision report when it becomes available. This report will provide important clarity about the events that led to your loved one’s passing.

If you are considering next steps, it may help to speak with an attorney experienced in pedestrian fatality cases. They can explain your family’s rights and assist with any legal or insurance-related matters.

Most importantly, take time to grieve and seek support. Family, friends, and local grief-counseling resources in Oceanside can provide comfort as you remember and honor your loved one’s life.

If you have any concerns about navigating the legal process surrounding this incident, call 866-883-4318 to speak with a lawyer.
