    (Palm Springs, CA) A San Rafael Drive crash killed Raymond Olguin Jr., 29, of Palm Desert after a vehicle struck him Tuesday night.


    On Tuesday, September 16, shortly before 9:00 p.m., the San Rafael Drive crash occurred. According to the Riverside County Coroner’s Office, it happened near the intersection of San Rafael Drive and Avenida Caballeros in Palm Springs.

    Palm Springs Police officers arrived and found Raymond Olguin lying in the roadway. Paramedics attempted life-saving measures, but he died at the scene. Investigators reported that the driver remained at the location and cooperated with police. Authorities confirmed that drugs and alcohol do not appear to have been factors in the San Rafael Drive crash. Police temporarily closed eastbound and westbound lanes on San Rafael Drive and Avenida Caballeros while conducting their investigation.

    Legal Opinion on the San Rafael Drive Crash

    The San Rafael Drive crash that killed Raymond Olguin Jr. raises critical issues under California law. Although the driver stayed at the scene, investigators must still determine whether negligence contributed to the collision. One key law is California Vehicle Code 21950, which requires drivers to yield to pedestrians crossing within marked or unmarked crosswalks at intersections. If Olguin had been crossing at or near the intersection, the driver may have had a duty to yield.

    If Olguin crossed outside of a crosswalk, California Vehicle Code 21954 applies. This statute requires pedestrians outside crosswalks to yield to vehicles. Regardless, the law still places a duty of care on drivers to avoid hitting them whenever possible. Speed may also be reviewed. California Vehicle Code 22350, the Basic Speed Law, requires drivers to travel at speeds safe for conditions, especially at night in residential or city areas. If the driver traveled too fast to react in time, liability may apply.

    Because Olguin died, his family has the right to file a wrongful death claim under California Code of Civil Procedure 377.60. This law allows relatives to seek damages for funeral expenses, loss of financial support, and emotional suffering.

    Olguin’s family should contact a wrongful death attorney immediately.
