Overview on the Pacific Highway Accident
When a pedestrian is struck by a vehicle, investigators often review the Pedestrian Right-of-Way Law. This law requires drivers to exercise due care and yield to pedestrians crossing the street, even outside a crosswalk. Investigators will likely examine whether the driver could have taken action to avoid the impact.
If speed contributed to the collision, the Basic Speed Law may also be relevant. It prohibits driving faster than is safe for current conditions, including visibility and pedestrian presence near intersections. Excessive speed can greatly increase both the likelihood and severity of pedestrian injuries.
Additionally, if distraction or inattention played a role, the Distracted Driving Law could apply. This law bans the use of handheld devices while driving and is meant to prevent avoidable crashes caused by lack of focus. These statutes will help determine how the Pacific Highway accident occurred.
