(Phoenix, AZ) A man using a motor wheelchair was killed Sunday night, December 14, in a 60th Lane crash in west Phoenix.
Officers responded around 9:38 p.m. to 60th Lane and McDowell Road after reports of a vehicle striking a pedestrian. Police arrived to find the man critically injured. Phoenix Fire paramedics transported him to a nearby hospital, where he later died.
The driver of the car remained at the scene, cooperating with investigators. Paramedics also took them to a hospital with non-life-threatening injuries. Preliminary information indicates the man in the motor wheelchair crossed northbound outside the crosswalk. As he did, the driver of the vehicle struck him. Police say they do not suspect impairment, and the Vehicular Crimes Unit is continuing the investigation.
Overview on the 60th Lane Crash
When a pedestrian or mobility device user crosses outside a designated crosswalk, investigators often reference the Pedestrian Roadway Law. This statute requires pedestrians to yield to vehicles when crossing outside a marked or unmarked crosswalk. Though the man was in a motor wheelchair, the same safety principles apply, and officers will evaluate whether approaching drivers had enough time to react.
Even so, drivers must still operate with caution, which is why analysts also consider the Duty to Exercise Due Care Law. This law requires motorists to take reasonable steps to avoid colliding with pedestrians in the roadway. Investigators will assess visibility, speed, and roadway lighting to determine whether due care was used in the moments leading up to the 60th Lane crash.
Additionally, police may review the Basic Speed Law. This statute requires motorists to travel at speeds appropriate for traffic and nighttime conditions. Even when impairment is not a factor, safe speed can significantly affect a driver’s ability to stop or swerve in time.
